Terms of Service
- You can try ResidentLift free for 14 days with no card. After that it's a paid subscription, priced per house.
- Your data is yours. We host it to run the service for you, we don't sell it, and you can export it.
- You are responsible for how you run your houses: resident consent, fair housing, rent and landlord-tenant law, and anything you send residents.
- Rent payments run through Stripe, directly to you. ResidentLift never holds your money and takes no cut of rent.
- ResidentLift is software, not legal, clinical or financial advice, and we don't sign HIPAA business associate agreements.

1. Who these terms are between
These Terms of Service ("Terms") are an agreement between ResidentLift LLC, a Wyoming limited liability company ("ResidentLift", "we", "us"), and the business or organization that creates a ResidentLift account ("Customer", "you"). They cover the ResidentLift web application, websites, emails and related services (the "Service").
If you accept these Terms for a company, nonprofit or other organization, you confirm that you are authorized to bind it, and "you" means that organization. You must be at least 18 years old. The Service is for operators of recovery residences, sober living homes, transitional and re-entry housing, and similar programs. It is a business service and is not offered for personal, family or household use.
You accept these Terms by checking the box when you sign up, or by using the Service. Our Privacy Policy explains how we handle personal information and is part of these Terms.
2. Definitions
- House: one residence or program location set up as a house in your account.
- Account: your organization's ResidentLift account, which may include several Houses.
- Authorized Users: the owners, co-owners, admins, managers and other staff you give access to your Account.
- Residents: residents, applicants and former residents of your Houses, including those who use the resident portal.
- Customer Data: everything you, your Authorized Users and your Residents put into the Service, including information about Residents and applicants.
3. Your account
You must give accurate signup information and confirm your email address. You are responsible for keeping passwords secure, for everything done under your Account, and for the people you give access to, including removing access when someone leaves. Tell us right away at support@residentlift.com if you believe your Account has been accessed without permission.
So we can support you, our authorized personnel may have co-owner access to your Account. We use it only to provide support, keep the Service secure and working, and meet legal obligations, as described in the Privacy Policy.
4. Free trial
New Accounts get a free trial of 14 days, starting when you sign up. No payment card is required. During the trial you can add billing at any time and you won't be charged until the trial ends.
If the trial ends without billing set up, you keep full access for a 7-day grace period. After that the Account becomes read-only (see Section 6) until you subscribe. One free trial is allowed per organization. We may shorten, end or refuse a trial if we reasonably believe it is being misused, for example by creating repeated accounts. The trial is provided "as is" (see Section 19).
5. Subscription, fees and billing
Price. The Service is priced per House, using the prices shown on our pricing page and in the Billing screen of your Account when you subscribe. At launch the prices are $49 a month for each of your first three Houses, $29 a month for each House from the 4th to the 10th, and $15 a month for each House after that, or ten times the monthly amount for an annual plan. Houses we have marked as complimentary are not counted.
Automatic renewal. Subscriptions are billed in advance for each monthly or annual period and renew automatically at the end of each period until you cancel. By subscribing, you authorize us, through our payment processor Stripe, to charge your payment method for each renewal and for the other charges described here.
Adding Houses. Your fee is based on the number of Houses in your Account. Before you add a House, the Service shows your new total and asks you to confirm it. On a monthly plan, the prorated difference for the rest of the current month is added to your next bill. On an annual plan, the prorated difference for the rest of the year is charged when you add the House. If a House is removed from your Account, your fee goes down, and any prorated credit for the rest of the period is applied to your next bill rather than refunded. When you cancel, we do not refund the unused part of the current period.
Price changes. We may change prices with at least 30 days' notice by email or in the Service. A change takes effect at your next renewal after the notice period and does not change what you have already paid for the current period.
Taxes. Prices do not include taxes. You are responsible for any sales, use or similar taxes that apply, and we will add them to your bill where we are required to collect them.
Failed payments. If a payment fails, we and Stripe will retry it for about two weeks and let you know. You keep full access during that time. If the payment still can't be collected, your Account becomes read-only until the balance is paid.
Refunds. Fees are non-refundable except where the law requires otherwise or where we decide to issue a refund or credit at our discretion. If you believe you were billed in error, email us within 60 days of the charge. Please contact us before opening a dispute with your card issuer.
Complimentary plans. If we give your Account or a House complimentary access, we may end it with at least 30 days' notice, after which the regular fees apply if you continue using the Service.
6. Read-only mode and suspension
When an Account is read-only, Authorized Users can still sign in, view and export Customer Data, and manage billing, but cannot add or change records. We designed read-only mode so that Residents are not affected: the resident portal, Residents' online rent payments to you and your public screening form keep working. Automated emails to Residents, such as rent reminders, may pause. Paying the balance or subscribing restores full access right away. Nothing is deleted because an Account is read-only.
We may also suspend all or part of the Service, with notice when we reasonably can, if your use breaks these Terms or the law, threatens the security or operation of the Service, or exposes us or others to harm.
7. Your data
You own Customer Data. You give us permission to host, copy, process, transmit and display Customer Data only as needed to provide, secure and support the Service for you, to follow your instructions, and to comply with the law. We process information about Residents and applicants on your behalf, as your service provider.
What we don't do. We do not sell Customer Data, use it for advertising, or share it with third parties except the service providers that help us run the Service and as the Privacy Policy describes. We may create aggregated, de-identified statistics about how the Service is used (for example, how many Houses use a feature) that do not identify you, any Resident or any individual, and use them to operate and improve the Service.
Export. You can export Customer Data from the Service, including the accountant package and spreadsheet exports, at any time, including while the Account is read-only and for 30 days after it ends (see Section 18).
Accuracy. Balances, reminders, deferral amounts and reports are calculated from the information you enter and your settings. You are responsible for checking them before relying on them or sending them to Residents.
8. Resident information and privacy laws
Customer Data can include sensitive information about Residents, such as recovery status, drug screen results, meeting attendance and signed documents. You are responsible for:
- having a lawful basis, and any notices and consents required by law, for collecting Resident and applicant information, putting it into the Service, and letting us process it for you;
- deciding who on your team can see what, and only collecting what you need;
- complying with the laws that apply to you, including state privacy, landlord-tenant and recovery-residence certification rules and, if your program is subject to it, the federal confidentiality rules for substance use disorder records at 42 C.F.R. Part 2;
- using the Service's release-of-information and consent tools correctly. They are provided to help you, are not legal advice, and do not by themselves make any disclosure lawful.
No HIPAA business associate agreement. ResidentLift does not currently sign business associate agreements. If you are a covered entity or business associate under HIPAA (for example, if you bill health insurance electronically), you must not use the Service to create, receive, maintain or transmit protected health information unless we have first signed a written agreement with you that says otherwise.
Email is not for sensitive details. Do not put drug screen results, diagnoses, treatment information or similar sensitive details in notes or fields that are sent by email (for example, custom reminder text). The Service is designed so that the emails it sends to Residents do not include that kind of information.
9. Screening, admissions and fair housing
The Service includes tools such as a public screening form, flags, automatic declines and a waitlist. You decide the questions, rules and decisions, and you are solely responsible for them. You agree to use these tools in compliance with the federal Fair Housing Act, the Americans with Disabilities Act, Section 504 of the Rehabilitation Act and state and local fair housing and anti-discrimination laws.
Please note that people in recovery from substance use disorder are generally protected as people with a disability under fair housing law, and that housing providers may have to make reasonable accommodations. Do not use the Service to screen out or treat applicants or Residents differently on a protected basis. ResidentLift does not make admission, discharge or eviction decisions and does not review your criteria.
10. Rent payments through Stripe
If you turn on online rent payments, payments are processed by Stripe, Inc. and its affiliates ("Stripe") through a Stripe account in your name. You must accept Stripe's agreements, including the Stripe Connected Account Agreement, which governs your relationship with Stripe. ResidentLift is not a party to payments between you and your Residents, does not hold, receive or transmit your funds, and is not a bank or money transmitter. Funds go from Residents to your Stripe account.
ResidentLift does not charge a platform fee on rent. Stripe charges its own processing fees under its pricing. You are responsible for refunds, disputes, chargebacks and their fees, and for following landlord-tenant, fee, late-fee and consumer protection laws when you charge Residents. You authorize us to share the information Stripe needs to provide payments to you and to show payment information in your Account.
11. E-signatures, forms and messages to residents
You can use the Service to send documents for electronic signature, collect intake forms, and send emails and links to Residents. You are responsible for the content of your documents and messages, for making sure they are appropriate and lawful, and for any consent required to send them. Electronic signatures are captured to support enforceability under the federal ESIGN Act and state electronic transaction laws, but whether a particular document is valid and enforceable depends on its content and your process, which we don't review. Messages sent through the Service on your behalf come from your House and are your communications.
We may send you service, billing, security and account emails. These are part of the Service, and you can't opt out of them while you have an Account.
12. AI help assistant
The Service includes an in-app help assistant powered by a third-party AI model. Its answers are generated automatically and may be wrong or incomplete. Check important answers, and do not rely on it for legal, clinical, financial or compliance decisions. Do not type Resident names or other personal or sensitive information into the assistant. What you type is sent to our AI provider to produce an answer, as described in the Privacy Policy.
13. Acceptable use
You and your Authorized Users must not:
- use the Service in violation of any law, or to harass, exploit, discriminate against or harm Residents or anyone else;
- upload content you don't have the right to use, or malicious code;
- try to access another customer's data, probe or test the Service's security, or get around access controls, limits or read-only mode;
- overload, scrape or reverse-engineer the Service, except where the law expressly allows it;
- resell, sublicense or provide the Service to third parties as a service bureau, or use it to build a competing product;
- share logins between people, or create accounts by automated means or to obtain repeated free trials;
- use the Service for emergencies. ResidentLift is not monitored around the clock and is not an emergency, crisis or medical service. In an emergency, call 911. For a mental health or substance use crisis, call or text 988.
14. Third-party services
The Service relies on and may connect to services run by others, such as Stripe for payments, our hosting and database providers, our email provider and our AI provider. Your use of a third-party service you connect to (such as your Stripe account) is governed by that provider's terms. We are not responsible for third-party services we don't control, but we choose our providers carefully and require them to protect data.
15. Availability, support and changes
We work to keep the Service available, secure and backed up, but we don't promise it will be uninterrupted or error-free, and we don't offer a service level agreement unless we sign one with you. We may need maintenance windows, and we will try to schedule them at quiet times. Support is provided by email and through the in-app help button. We may improve and change the Service over time. If we remove a feature you materially rely on, we will give you reasonable notice when we can. We recommend that you regularly export the records you need to keep.
16. Ownership and feedback
We own the Service, including its software, design, documentation and trademarks. These Terms give you a limited, non-exclusive, non-transferable right to use the Service for your own operations while your Account is in good standing. If you send us suggestions or feedback, we may use them without any obligation to you.
17. Confidentiality
Each of us will protect the other's non-public information shared in connection with the Service with reasonable care, use it only for purposes of these Terms, and not disclose it except to people who need to know it and are bound to protect it, or where the law requires disclosure (in which case, where allowed, the disclosing party will give notice). Customer Data is your confidential information.
18. Cancellation and termination
By you. You can cancel your subscription at any time in the Billing screen. Cancellation takes effect at the end of the current paid period, and you won't be charged again. To close your Account and have your data deleted, email us.
By us. We may end these Terms or your Account if you materially breach them and don't fix the breach within 15 days after notice, if fees remain unpaid for more than 30 days after the Account becomes read-only, immediately if your use is unlawful or puts the Service, Residents or others at serious risk, or with 60 days' notice for any reason (in which case we'll refund any prepaid fees for the period after termination).
Your data afterwards. After cancellation or termination, the Account stays available in read-only mode for at least 30 days so you can export Customer Data. After that we may delete it, and we will delete it within 90 days after a written request from you, except for copies we must keep by law, records of billing and acceptance of these Terms, and copies in backups, which are deleted as the backups roll over and remain protected until then.
Sections 5 (for amounts owed), 7, 8, 9, 10, 17, 18, 19, 20, 21, 22 and 24 survive termination.
19. Disclaimers
ResidentLift is a software tool. It does not provide legal, clinical, medical, treatment, financial, accounting or tax advice, and it is not a recovery residence, treatment provider, certification body or property manager. Templates, sample documents, consent forms, guides and help-assistant answers are general information only. Talk to your own attorney, accountant or certification body about your obligations.
Except as expressly stated in these Terms, the Service is provided "as is" and "as available", and to the fullest extent allowed by law ResidentLift disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the Service will be uninterrupted, error-free or meet your requirements.
20. Limitation of liability
To the fullest extent allowed by law: (a) neither party will be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, even if advised they were possible; and (b) each party's total liability arising out of or relating to these Terms or the Service will not exceed the fees you paid to ResidentLift in the 12 months before the event giving rise to the claim (or $100 if you paid nothing).
These limits do not apply to your obligation to pay fees, to your obligations under Section 21, or to liability that cannot be limited by law.
21. Indemnification
You will defend and indemnify ResidentLift and its members, managers and personnel against third-party claims, and the resulting losses, damages, fines and reasonable attorneys' fees, that arise from: Customer Data or your collection and use of it; your operation of your Houses, including admissions, screening, discharges, evictions, rent and fees; your messages and documents to Residents; your violation of these Terms or the law; or a dispute between you and a Resident, applicant or staff member. We will give you prompt notice of a claim, reasonable cooperation at your expense, and let you control the defense, but you may not settle a claim that imposes obligations on us without our consent.
22. Disputes and governing law
If a dispute comes up, please email us first. We will both try in good faith to resolve it within 30 days before either of us starts a legal proceeding (except for urgent requests to protect data, intellectual property or confidential information).
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any lawsuit about these Terms or the Service must be brought in the state or federal courts located in Florida, and both parties consent to the jurisdiction of those courts. Claims must be brought individually, not as a plaintiff or class member in a class, collective or representative action. To the extent allowed by law, each party waives the right to a jury trial.
23. Changes to these terms
We may update these Terms. For material changes we will give at least 30 days' notice by email or in the Service before they take effect, except for changes required by law or relating to new features, which can apply sooner. The version date at the top shows the current version. If you keep using the Service after a change takes effect, the updated Terms apply. If you don't agree, you can cancel before that date.
24. General
These Terms, the Privacy Policy and any order or written agreement you sign with us are the entire agreement between us about the Service. If a provision is found unenforceable, it will be limited to the minimum extent needed and the rest stays in effect. Not enforcing a right is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of our business or assets, and will tell you if we do. Neither party is liable for delays caused by events beyond its reasonable control. We are independent contractors. Notices to you may be sent to your Account email or shown in the Service; notices to us must be sent to support@residentlift.com. You agree to receive agreements, notices and other communications electronically.
